Agreement to Terms

By accessing and using OnboMail, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

OnboMail is a SaaS platform that helps businesses automate user onboarding through email sequences. We provide:

• Email sequence templates and automation
• Integration with Supabase for subscriber management
• Analytics and performance tracking
• Team collaboration features

User Accounts

To use OnboMail, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

Acceptable Use

You agree not to use OnboMail to:

• Send spam or unsolicited emails
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or harmful content
• Interfere with the service or other users
• Collect personal information without consent

Data Processing Agreement

As a customer, you are the data controller for subscriber emails you collect. OnboMail acts as a data processor. You warrant that:

• You have lawful basis for collecting subscriber emails
• You have obtained necessary consents
• You comply with applicable privacy laws (GDPR, CCPA, etc.)
• You will handle data subject requests appropriately

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. You agree to:

• Pay all fees when due
• Provide accurate billing information
• Update payment methods as needed
• Accept automatic renewal unless cancelled

Refunds are provided according to our refund policy. Fees are non-refundable except as required by law.

Service Availability

We strive to maintain high service availability but cannot guarantee 100% uptime. We may temporarily suspend service for maintenance, updates, or other operational needs.

Intellectual Property

OnboMail and its content are protected by intellectual property laws. You retain ownership of your data and content. We retain ownership of our platform, code, and proprietary features.

Limitation of Liability

OnboMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will cease
• You may export your data within 30 days
• We will delete your data according to our retention policy
• Outstanding fees remain due

Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or through the service. Continued use constitutes acceptance of modified terms.

Governing Law

These terms are governed by the laws of Europe. Any disputes will be resolved through binding arbitration or in the courts of Europe.
